The federal judge Julian Ercolini This Monday he rejected “in limine” the annulment proposal made by the former president’s defense Alberto Fernandez against the summons of the former president to an investigative statement in the cause insurancereported judicial sources. Given this decision, the summons for Fernández’s investigative statement next Wednesday at 10 o’clock remains in force.

The former president had demanded that the “absolute nullity” of the summons for an investigative statement in the insurance casescheduled for next Wednesday and suspended until a decision on the proposal that has just been presented is finalized.

In a letter signed by his lawyer Mariana Barbitta, the former president maintains that the subpoena in this investigation is “absolute nullity” and “lacks foundations” in addition to constituting a “subjugation” of his right to defense, judicial sources told Agencia Noticias Argentinas.

The defense asked federal judge Julián Ercolini to suspend the hearing, something that the magistrate must decide. “It intends to subject him to criminal proceedings based on an accusation that is directionally ‘forced’, generic, unclear and in violation of legal and constitutional provisions,” the document maintains.

In addition, the call is null, according to the defense, because it was ordered by a judge who was challenged and that proposal is under review by the Supreme Court of Justice of the Nation, through a complaint appeal.

Fernández is scheduled for next Wednesday and, if completed, it will be his first investigative statement accused in a criminal case since he left the government.to give explanations about the contracting of insurance policies for public organizations through his friend, the broker Héctor Martínez Sosa.

Photographs found on the cell phone of Fernández’s former private secretary, María Cantero, were included in the judicial case, where the then president and Martínez Sosa are seen meeting in an office on the Olivos villa, in front of graphs and papers, reported sources from the case.

This is part of the evidence that will be shown to the former president in front of federal judge Julián Ercolini and prosecutor Carlos Rívolo, in charge of the case.

One of the images is from July 3, 2021 and is one of several found on Cantero’s cell phone assessed by Justice in this criminal case.

Fernández will open the round of investigations that includes 38 other defendants. On December 11, he will have to appear for the second summons before the same magistrate, in another criminal case in which he is accused of gender violence against former first lady Fabiola Yañez.

In the insurance case, the former president is accused of “having jointly intervened in a coordinated and functional manner, approximately between December 2019 and December 2023, in a scheme for the collection and distribution of public funds through irregular direction in contracting.” and intermediation in insurance taken by different public departments in ‘NACIÓN SEGUROS SA'”.

To this end, “a part of those named, with the connivance of Fernández, would have operated in the contracting of insurance from various state entities, and especially through the intermediation of individuals and companies between said entities and the insurer ‘NACIÓN SEGUROS SA ‘”, details the accusation.

Also “in the inclusion of co-insurance companies by it. The maneuver would have required the intentional intervention of public officials of ‘NACIÓN SEGUROS SA’ and also of the different state departments that take out the insurance in question.”

In addition, they are summoned for investigation Hector Martinez Sosa and his wife Stonecutter and two other brokers Pablo Torres García and Oscar Castello.
