Employees of the Spasskiye Vorota-M insurance group, who may be involved in fraud with the company’s assets, face up to four years in prison. Alexander Inoyadov, head of the criminal practice of BMS Law Firm, told Izvestia about this. He explained that part 1 of Art. 172.1 of the Criminal Code of the Russian Federation, which, in case of establishing the guilt of specific persons or a person, entails the risk of imposing a penalty in the form of a fine, forced labor, imprisonment for up to four years with a ban on holding positions or engaging in certain activities.
“When establishing the presence of a sign of a group of persons by prior agreement or an organized group, liability already arises under Part 2 of Art. 171.2 of the Criminal Code of the Russian Federation. This crime is serious and may result in the imposition of a real sentence in the form of imprisonment for up to seven years,” said Alexander Inoyadov.
A criminal case against the Spasskiye Vorota-M insurance group was initiated under Part 1 of Art. 172.1 of the Criminal Code of the Russian Federation (“Falsification of financial documents for accounting and reporting of a financial organization”), Izvestia learned. Earlier, the Bank of Russia asked to check the company. In accordance with the statement of the regulator, the insurer, trying to hide the actual lack of assets as of September 30, 2020 (at the end of the third quarter), provided the Central Bank with false information about the availability of funds in accounts with Intesa and VTB banks.
In addition, in these reports, the insurer reflected false information about the purpose of real estate objects, the Central Bank said in a statement. According to the investigation, the falsification of the financial statements was required to avoid revocation of the license. While there are no suspects in the materials, a criminal case has been initiated against unidentified persons of the Spasskiye Vorota-M group.
The insurer has been operating on the market since 1992. In December 2020, the Bank of Russia revoked the license for compulsory health insurance from the Spasskiye Vorota-M group. According to the Deposit Insurance Agency, from April 22, 2021, bankruptcy proceedings are underway with respect to the Spasskiye Vorota-M insurance group. As of October 1, the company was exposed to claims for 113.4 million rubles, and none of this amount was paid.
