With the aim of separating the legal responsibilities of the driver and passenger in motorcycle vehicles in cases of test alcohol levelthe Buenos Aires legislator Yamil Santoro (United Republicans) presented a bill that proposes key changes to the Transit and Transportation Code of the Autonomous City of Buenos Aires. Ramiro Marra and Jorge Retafrom La Libertad Avanza, are co-authors of the initiative.
The current regulations do not adequately contemplate the separation of responsibilities between both parties. This can generate unfair scenarios, in which the driver, even complying with the blood alcohol limits and legal provisions, is sanctioned due to the conduct of the passenger.
“With this project we are solving a very unfair situation: the law is absurd and poses an excessive consequence that is not related to the protected legal good. Furthermore, a passenger who acts in bad faith can deeply harm a worker who is carrying out a motorcycle transportation service. That is why we propose this modification. We continue working on updating legislation that requires it, or eliminating legislation that is obsolete or that excessively limits the freedom of Buenos Aires residents,” explained Santoro.

Alcoholemia: what the project to modify responsibilities consists of
The project modifies article 5.4.5 of the Code to establish that, in the event that motorcycle companions exceed 0.5 grams of alcohol per liter of blood, the control authority will order their immediate descent. It also releases the driver from any liability if he or she complies with the legal blood alcohol limits.
This project will seek to avoid cases like that of “Ciro”, the driver of a transportation application who picked up a passenger in the early hours of New Year’s Eve. Despite not having alcohol in his blood, he was affected by the condition of his eventual passenger, who did test positive. Ciro’s motorcycle was seized, preventing him from working on a high-demand night, with the consequent impact on his income.

The National Road Safety Agency (ANSV) strengthened road safety during the beginning of 2025, carrying out more than 94 operations on routes, highways and urban areas from all over the country. With operations deployed in strategic points throughout the country, the ANSV seeks not only to sanction infractions, but also educate the population about the importance of respecting traffic rules. The objective is to build a road culture based on safety and mutual respect.
