The Ministry of Justice slowed down the project to transfer aircraft to the national registry

The Ministry of Justice criticized the project of the Ministry of Transport to cancel the registration of rights to aircraft, follows from the conclusion of the department, which Izvestia got acquainted with. The cancellation of the registration of rights is intended to popularize the registration of the aircraft themselves in the register of the Federal Air Transport Agency, the Ministry of Transport believes.

“An aircraft registration certificate is issued only for the purposes of registration and does not certify the ownership of the aircraft,” says the conclusion to the draft federal law “On Amendments to Certain Legislative Acts of the Russian Federation in Part of the Cancellation of State Registration of Rights to Aircraft and Transactions with them.”

The amendments developed by the Ministry of Transport will lead to “a number of adverse legal consequences” associated with transactions with aircraft, make it difficult for the circulation of aircraft and lead to new litigation, the Ministry of Justice added.

Leasing companies, on the contrary, support the initiative of the Ministry of Transport. This was reported to Izvestia in STLC, Sberbank Leasing, VTB Leasing and PSB Leasing. Also, S7 Airlines spoke out for the cancellation of the registration of rights.

For several years, Rosaviatsiya has been urging aircraft owners – air carriers and leasing companies – to register them in the national register. But for now, they prefer registration in Bermuda (UK) and Ireland because of the benefits and a clear and well-established paperwork process. In March 2021, the head of the Federal Air Transport Agency, Alexander Neradko, announced that from 2023, the authorities may impose a ban on the registration of aircraft in other countries. Today, up to 70% of the aircraft fleet of Russian airlines is registered not in Russia, but in Bermuda and Ireland.
