If it was a murder, who or who carried out the act?
After 10 years, justice admits that it is not known. The test does not reliably show the presence of third parties.
And there are conflicting expert opinions in the case.
The expert opinion carried out by the Forensic Medical Corps of the Supreme Court, which presented its report in May 2015, concluded that there were no elements to support the participation of third parties in the death of the prosecutor.
13 of the 15 experts said it, with the only dissent from experts from Nisman’s family. The specialists reported that they had not found any evidence to support that it had been a homicide. They found no evidence that Nisman had been drugged with ketamine.
Then the National Gendarmerie carried out another expert report, which is what the federal justice system took to maintain that it was a murder with two attackers. The report from that force’s experts concluded that Nisman was beaten, drugged with ketamine and taken to the bathroom.
They put him on his knees in front of the bathtub with his right knee resting on the floor, while one attacker held him and the other shot him.
time of death
Regarding the time of death, according to the Gendarmerie report taken by the prosecution, The experts determined that the homicide would have occurred at 2:46 a.m. on Sunday, January 18, 2015, with a certainty of 98%.
But on this point there are also conflicting versions since the Court’s experts maintained that death occurred at noon, and the complaint’s experts placed the time of death between 5:00 p.m. on the 17th and 1:00 a.m. on Sunday the 18th.
Doubts about the building’s security cameras
According to the report released by the prosecutor’s office, more than 100 security cameras were surveyed. “A considerable percentage were not fully functional or reported recording gaps.” In some cases the images were black or very difficult to view.
The three towers of the Le Parc complex had a total of 127 security cameras, of which 34 were those that had not worked since before the weekend in which prosecutor Nisman died. The others worked and captured images.
Regarding the other 93, the Federal Police carried out an analysis and handed over more than 55 thousand images to the justice system..
These images are of the exterior of the complex, of the ground floor, the elevators, the basements and the open air areas of each of the towers.
You can see in the images the staff of the buildings, who entered and left, the cars in the garages and the people who passed through the door.
However, the experts stated in the report that some cameras had very low quality, and others, due to their location, were in places with poor lighting.
The judicial investigators, when analyzing the images, revealed that nothing irregular was detected in terms of possible movements that could generate suspicion.

After the testimony of hundreds of witnesses and the analysis of what the cameras revealed, the investigators detected “blind spots” that were not captured by security cameras.
There are several questions. Could a person enter the building without being detected by the cameras?
If most of the cameras were working, and they recorded everyone who entered on the day of the death, should they have detected if someone went up to the 13th floor?
For prosecutors, the expertise allowed them to determine “a significant number of deficiencies regarding the operation of the security cameras, which shows that it was not too difficult to enter and leave the complex without being captured by the monitoring system installed there”
In addition, they maintained that the malfunction of the cameras was a recurring complaint from neighbors.
The bathroom door and access to the apartment
Nisman’s body was fallen on the bathroom door, on the inside. The apartment was closed from the inside.
Prosecutor Taiano reproduced the statement of the locksmith, who maintained that at the service door, he only had to push the key “with a small turn of one millimeter, locking it, which made it possible to easily open it.”
But before the locksmith’s intervention, the prosecutor’s mother, Sara Garfunkel, acted, opening the upstairs key before the locksmith arrived.
That is to say, the door was locked from the inside, Garfunkel opened the top lock and the locksmith opened the bottom one.
The mother opened the top lock with a key. He could not open the lower one, because another key was placed inside the apartment.
The weapon
In its report, the Prosecutor’s Office concluded that more than 80 people passed through the scene of the incident, and that the delimitation of the place led to irregularities that threatened the preservation of evidence.
No precautions were taken to properly safeguard the weapon, they acknowledge.

How the alleged murderers got out
The Prosecutor’s Office admits that to this day it is not known “if the perpetrators of the homicide could have left the apartment through the access route located in the kitchen that no one noticed during the first moments of the investigation.”
Next to the service door there was a space with a grated floor where the air conditioners were, which communicates with the adjacent apartment.
The prosecution maintained that this space was not searched the night the body was found due to the “poor workmanship” of the procedure. The hypothesis is that the murderers could have come out from there.
The computer and technological expertise
The computer expertise of the National Gendarmerie determined that on the morning of Sunday, January 18, Nisman’s computer was on. According to that report, it was not hacked and was used to browse various internet sites starting at 7:01 in the morning. According to the Gendarmerie’s expert opinion, at that time Nisman was already dead.
From the conclusions of the expert opinion taken by the prosecutors, it emerges that the remote program “Teamviewer” was installed on the Samsung brand computer that was in Nisman’s apartment.
Diego Lagomarsino

The only person who had a remote user account that allowed access to Nisman’s computer through this application was Diego Lagomarsino.
In this regard, it was relevant for the prosecutors to clarify that “it was not a necessary condition for the user to authorize each remote access on the screen,” as well as that Lagomarsino did not need a password to enter, since it was enough to have the referred user.
The “Teamviewer” program runs automatically when the computer is turned on, the only requirement for its operation.
The prosecution itself admits that “it cannot be established whether it was Nisman who carried out the actions that appear in the event log of the “Windows” operating system and in the web connection logs, if he did so.
a third person physically or Lagomarsino through its remote user.”
Without oral trial
The computer expert Diego Lagomarsino is prosecuted and accused of being a necessary participant, for having provided the weapon that caused the death of the prosecutor.
There are also four Nisman custodians who were prosecuted for breach of public official duties and two of them for concealment.
The prosecutions are final, but the oral and public trial has not yet been held.
It was recently charged Luis Alberto Heiler -General Prefect of the Argentine National Prefecture-, Roman Di Santo -Chief of the Argentine Federal Police-, Sergio Berni -Secretary of Security of the Ministry of National Security.
