Principling or necessary enforcement of law? An apartment building can be demolished again in Göttingen – it was built too high.
The city of Göttingen is allowed to tear down a newly built apartment building. According to media reports, the administrative court in the city of Lower Saxony in Lower Saxony has decided.
As the Norddeutsche Rundfunk (NDR) and the “Göttingen Tageblatt” report, a real estate company has built the house 1.26 meters higher than approved, namely with a eaves height of 7.76 meters instead of 6.5 meters.

The administrative court decided that neither approval had been granted for the construction nor had deviations from the applicable building regulations been approved. In short: the house was illegally built in this form – and can be demolished. “The complete elimination of the structural system,” said the construction supervision as early as 2016. This view has now been confirmed in court. The authorities now wanted to “take further steps”
The city administration is also concerned with making a sign that requirements are observed, a spokesman told the NDR. The work on the house has been quiet for around ten years. Since then, a legal hickhack has been running around the building height.
According to NDR, the city emphasized that it was still available for a compromise with the client. For example, a partial dismantling is conceivable. The extent to which the real estate company will approach the town hall is unclear.
