Justice supports consumer advocates in the fight against bogus discounts








The district court of Düsseldorf decided in the dispute over discounts at discounters in favor of consumer protection. However, the judgment is not yet final.

Discounters have to ensure more transparency in their advertising with price reductions. At least the district court in Düsseldorf decided in a dispute between Aldi Süd and the Baden-Württemberg consumer center, as a court spokeswoman confirmed (Az.: 38 O 284/24). The “food newspaper” had previously reported.

So it is not enough if Aldi with a crossed-out “non-binding price recommendation” (RRP) and a percentage price reduction advertises without specifying the 30-day best price, i.e. the lowest price of the past 30 days. The Baden-Württemberg consumer center has prevailed with its complaint.

Fight against moon prices

Among other things, the discounter had advertised with apparently lush percentage price cuts for chips. However, the price regulation that has been in force since 2022 stipulates that the cheapest price of the last 30 days must also be mentioned.

This is intended to advance moon prices, i.e. excessive UVP price information and price increases shortly before the price reduction. According to the newspaper, Aldi believed that a mere UVP counterpart was still permitted without specifying the 30-day best price.

The judgment of last Friday is not final, Aldi can appeal that the Düsseldorf Higher Regional Court would decide.
