What is part of the filling quantity of ready -made packaged sausage? Only the sausage roast or the cover and the clip clips? The Federal Administrative Court decided.

When the sausage is finished, the weight on the packaging must also correspond to the actual amount of sausage. The Federal Administrative Court of Leipzig decided that the weight of non -edible sausage sleeves and closure clips should not be taken into account when determining the filling quantity. “It must be the amount of food that is on the outside,” emphasized the chair of the 8th Senate, Ulla Held-Daab, at the same time the final decision.

In the specific case, the Eichamt North Rhine-Westphalia had a ban on sales for a liver sausage from a production company from the Warendorf district after the sausage had not been determined too little for samples. On the packaging, 130 grams had been specified as a filling quantity. However, the shell and the ties had been calculated for the sausage ends.

The process representative of the production company had argued in the negotiation that it was the shell and the brackets “forming elements” and was therefore part of the product. This is comparable to the pieces of wood in meat skewers. The Federal Administrative Court did not follow this reasoning. Therefore, the ban on sales is legally compliant.

Decision could have nationwide consequences

Before the court, it was about the individual case, but the decision should have nationwide radiance and thus also consequences for other producers of pre -packed food. The process representative of the state of North Rhine -Westphalia emphasized that there were numerous similar cases that were suspended until the current decision. “I assume that the producers will come before a possible sales ban and readjust accordingly,” said lawyer Philipp Gregor from Münster.

In the lower court, the North Rhine-Westphalian Higher Administrative Court (OVG) in Münster considered this practice as a legal compliant. The judges had justified that the amount of product was to be understood under the filling quantity, which also included the non -edible sausage pelle and closure parts. Because of the fundamental importance, the revision was approved to the Federal Administrative Court in Leipzig.

Consumer advocates welcomed the decision: Only the edible proportion of the sausage should make up the nominal filling quantity, it said from the Saxony Consumer Center on request. “A non -edible sausage bowl is not edible,” emphasized the local specialist for food and nutrition.
