The government extended the energy emergency and the intervention of regulatory entities until July 2026

The measure, formalized by Decree 370/2025, extends for a year the emergency in the electricity and gas sectors, and keeps the ENRE and Enargas under state control.

The National Government formalized on Monday, through Decree 370/2025, the extension of the emergency of the national energy sector until July 9, 2026, together with the extension of the intervention of the national Electricity Regulatory Entity (ENRE) and the National Gas Regulatory Entity (Enargas).

In addition to reaffirming the continuity of the emergency in the sectors of electricity and gasthe decree also provides for the Prolongation of the “transition period to focused energy subsidies”originally established by Decree 465/2024. This will allow the Ministry of Energy to continue advancing in the Restructuring of the subsidies regime with direct allocation mechanisms.

A new point in this standard is the CALL TO THE PROVINCES to work coordinated with the Ministry of Energy in the necessary measures to guarantee the provision of electrical services within their jurisdictions, as well as in the Implementation of focused subsidies policy.

In the recitals, the Executive stated again the critical situation inherited from the previous government, describing a “institutional, economic and social inheritance.” Three key areas of vulnerability of the current energy system are detailed: as a poor collection structure, a deterioration in the provision and distribution facilities and the absence of clear market signals both for producers and consumers.

The government maintains the measure that aims to improve transparency in rates

Likewise, the decree links this extension with the objectives of the Bases and starting points for the freedom of Argentines (Law No. 27,742)argue that the continuity of the emergency regime will contribute to Eliminate the opacity of ratesallowing users to clearly understand what part of the service they pay and which is subsidized.

“The continuity of the emergency of the energy sector declared by the present, in coordination with the provisions of the Bases and starting points for the freedom of Argentines No. 27,742will contribute to eradicating the opacity of the final rates and the confusion between the amounts invoiced and the subsidies, ”says the decree.

Finally, the Government remarks that this transparency in billing responds to Article 42 of the National Constitutionwhich guarantees the right of consumers to receive proper and truthful information about the goods and services they use.
