The public prosecutor does not accept acquittal for El Hotzo

A comment by satirist El Hotzo on the assassination attempt on Donald Trump in the US election campaign concerns the Berlin judiciary. That stays that way.

The comedian and satirist Sebastian Hotz alias El Hotzo on the attack on Donald Trump continued to deal with the judiciary about a year ago. The Berlin public prosecutor’s office has appealed against a judgment of the Tiergarten district court, as a court spokeswoman for the German Press Agency announced. The court had acquitted him of the allegation of approved the assassination attempt and thus disturbed public peace.

The 29-year-old’s post on platform X was not suitable for this, judge Andrea Wilms said in her reasoning on July 23. It was “impunity satire”, even if the statements may have been tasteless.

The public prosecutor demanded fine

The public prosecutor had requested a fine of 6,000 euros. The posts fell under the so -called hate crime and, among other things, because of their width effect – Hotz has around 740,000 followers on X – to disturb public peace. Such a climate would be created in which attacks on state officials could thrive.

According to a spokesman, the public prosecutor initially lodged an “indefinite appeal”. The further procedure of the authority depends on the written reasoning of the judgment, the spokesman said.

Shitstorm after controversial post

In mid -July 2024, an assassin shot on Trump in Pennsylvania and hit him on the right ear. One visitor died, two more were injured. The perpetrator was killed by security forces.

In a post, Hotz compared the shots on Trump to the “last bus” and commented: “Unfortunately just missed.” In addition, the 29-year-old wrote: “I find it absolutely fantastic when fascists die.”

Hotz deleted the controversial contributions shortly afterwards, but a shit storm broke out in the online media and there were several criminal complaints against him. An immediate consequence was that the public law ARD broadcaster Rundfunk Berlin-Brandenburg (RBB) ended the collaboration with Hotz at the youth radio station Fritz.
