“The April 18 date was set in accordance with California law and our Standards of Conduct because our agenda included Mr. Smith’s possible suspension or removal from membership,” Rubin wrote. “We were required to notify Mr. Smith 15 days in advance of a board meeting at which such action might be taken, and also to give him an opportunity to provide the board with a written statement no less than five days in advance of that meeting. ”.
Smith has already resigned from the Academy after the incident, which occurred after Rock made a joke about Jada Pinkett Smith onstage at the March 27 ceremony while making remarks before presenting the Oscar for Documentary Feature. Smith got up from his front row seat, walked over to Rock and punched him with an open hand, then returned to Rock’s seat.
Smith remained in the room and later won Best Actor for his role in “King Richard”.
Following the incident, the Academy issued a statement that night saying it “does not condone violence in any form.” Smith also apologized for his actions, though not to Rock. On March 29, there was a brief virtual meeting between Smith, Rubin and the Academy’s executive director, Dawn Hudsonwhich was started by Smith.
It’s unclear what sanctions are in the offing, as Smith has already resigned, but one possibility is that his Oscar win will be taken away.
