Russian state-run media outlet RIA is now reporting that 20 people (the minimum required in Russia for a class action lawsuit) have already joined the legal action against the streamer with around a hundred more people applying to join.
Netflix accumulated approximately one million subscribers since its launch in Russia in 2016. The subscription in Russia is 799 rubles ($9.67) per month.
The plaintiffs are represented by the Moscow-based law firm Chernyshov, Lukoyanov and Partners. According to ESTUARYthe case of the firm is that Netflix “entered into a public contract with subscribers that does not contemplate the possibility of unilateral refusal to comply with obligations”.
In this way, suspension of the streaming service violates the rights of users and constitutes a violation of the civil code of the Russian Federationas well as consumer rights laws.
The plaintiffs seek compensation of 60 million rubles (approximately US$730,000) for non-pecuniary damages, as well as a fine against Netflix equal to the amount awarded by the court. Additional penalties could be imposed if the platform loses the case and refuses to comply with compensatory orders.
