The family feud of the Guelphs has come to an end (for the time being): A judge at the Hanover district court dismissed a lawsuit against Ernst August Hereditary Prince of Hanover.
Ernst August von Hanover had sued his eldest son, Ernst August junior, for the return of various gifts. The Marienburg near Hanover also belonged to the mass of disputes. The hereditary prince wanted to transfer the castle to the state because the Guelphs could not guarantee maintenance. In the meantime, a foundation has been set up that owns the castle. The federal and state governments are giving a total of 27.2 million euros to have the necessary restorations carried out on the Marienburg.
The sale was not in the interest of the senior and Ernst August sued his son and Welfen boss. In March he withdrew the lawsuit and sold the claims to the Salzburg EAH BetriebsgmbH. As such, the Austrians took over as plaintiffs.

However, they were not successful either – the Hanover Regional Court dismissed the lawsuit. According to a spokeswoman, the court saw no basis for any claims by the company against Ernst August junior. The contract with which his father transferred his rescission claims to the company some time ago was already “ineffective for legal reasons”.
On the other hand, the actual prerequisite for a retransfer of the donation is also missing, as the chamber emphasized, according to the spokeswoman. According to the law, this would require “serious misconduct” on the part of the recipient, which cannot be determined in the present case. However, the legal process does not end there. The losing side could still appeal against the judgment before the Higher Regional Court.
