Paul Boggiothe plaintiff’s lawyer, assured that Tolo Rodríguez “has registered the song since 2012 in the National Directorate of Copyright and then in SADAIC” and warned: “The demand is for 22 million pesos but now it would have to be updated”, by virtue of the inflationary index.

“We are not asking for money that SADAIC did not pay, but we are claiming the violation of the rights of the work. The Palmeras have been in charge of hiding who is the author of ‘Asesina’ in a systematic way”, accused the lawyer.

“On two of their best-selling albums in their history as a band, The Philharmonic and Be Eternal Los Palmeraswhere they record the song with Andres Calamaroinstead of granting the corresponding credit to my client – who is 100 percent author of lyrics and music – they give it to two strangers, “he founded, on the lawsuit.

He also complained that “in 99 percent of their performances they don’t say they sang my client’s song. And the song has 30 million downloads on digital platformsappearing as artists Los Palmeras and Calamaro”.

“Authorship is systematically hidden. My client’s right is that when the work circulates, it is accompanied by his name,” he stated.

Regarding the amount of the demand, he specified that “we ask for a peso for each reproduction that the song had on digital platforms. At the time the lawsuit began, we had recorded 21,780,000 downloads (now there are almost 30 million), so at that time we set the amount at 22 million.”

Los Palmeras, which on July 8 and 9 will celebrate their 50 years of career with shows at the Movistar Arena, they have not made public statements on their social networks about the accusation of plagiarism against them.
