Johnny Depp avoids a new trial with an out-of-court settlement

However, after weeks of behind-the-scenes talks between the parties, it appears that Depp is paying Brooks to drop the lawsuit, just as he did with his former business managers in 2018.

“The settlement agreement conditions the dismissal of this matter upon satisfactory performance of specified terms that are not to be met within 45 days of the settlement date,” the settlement notice in the file reads. “An application for dismissal will be filed no later than 5/1/2023.”

“Dismissal after settlement is scheduled for 02/16/2023,” added a minute order from Judge Holly J. Fujie this morning.

Nearly two months after the actor was awarded more than $10 million in damages by a Virginia jury in his lengthy libel case against Heard over a Washington Post article, the Los Angeles trial for a 2017 nighttime altercation on the set of the film about the murder of Notorious BIG it was already projected to create another media frenzy.

The lawsuit filed alleges that Depp went berserk when Brooks informed him on April 13, 2017 that production had to end by tonight. Speaking to an off-duty LAPD officer on set in the process after being told by Furman to deal with Depp, things quickly became tense for Brooks when Depp approached. Allegedly yelling obscenities at the location manager, Depp then punched Brooks “twice on the lower left side of his rib cage causing him pain.”

Delayed by the pandemic, the case has been fairly dormant on the LASC docket until last month as the trial date neared. Now everything can be very quiet if the agreement is maintained.
