According to a police report, authorities discovered bottles were missing from the owners’ residence. After collecting statements and reviewing surveillance footage, police found probable cause to charge Miller with felony robbery.
NBCNews reports that a Vermont Superior Court clerk confirmed that the parties agreed to drop two charges, one of petty theft and one of burglary from a vacant dwelling. Miller is expected to plead guilty to trespassing Friday in Bennington County Superior Criminal Court.
Court documents indicate that prosecutors recommend that Miller face 89 to 90 days of suspended sentence, plus one year of probation and a $500 fine. The maximum sentence would have been 26 years.
The Vermont charges are just one of a series of controversies and legal problems Miller faced in the past year. The actor was arrested twice in Hawaii, first for disorderly conduct and harassment and then for second-degree assault. Miller has also previously been charged with choking a woman in an Icelandic bar.
Last August, Miller apologized for his behavior and stated that they would undergo mental health treatment. The actor was introduced as Barry Allen, aka The Flash, in 2017’s “Justice League.” Miller will star in the superhero’s first solo film, which hits theaters June 22.
