Hutchins was killed when a revolver Baldwin was rehearsing while filming in New Mexico fired a live bullet, hitting her and the film’s director. Joel Souzawho survived.

Prosecutors must now prove in court that the safety of firearms on the set began with Gutiérrez Reed, in charge of all weapons in production; it applied to Halls, who checked the gun and handed it over to Baldwin, and then extended to the actor.

Manslaughter is considered unintentional murder and carries a penalty of up to 18 months in prison in New Mexico and a $5,000 fine..

Baldwin denied responsibility for Hutchins’ death and has asserted that live ammunition should never have been allowed on the set of the low-budget film.

The actor claimed he was told the gun was “cold,” an industry term meaning it’s safe to use.
