The AfD MPs in the Bundestag initially fought vehemently against the mask requirement in Parliament and even sued in Karlsruhe. But apparently there has been a change of heart.
The Federal Constitutional Court has discontinued a procedure on the mask requirement in the Bundestag. The AfD had withdrawn its application, the court announced on Wednesday in Karlsruhe.
19 members of the parliamentary group had opposed the obligation ordered by Bundestag President Wolfgang Schäuble in autumn to wear mouth and nose protection in all buildings of the Bundestag. From their point of view, the CDU politician was not authorized to do so. With the withdrawal of the application, there is no longer a basis for a procedure, the court said. (Az. 2 BvE 10/20)
“There is no public interest in the continuation of the proceedings in view of the unanimously intended rejection of the inadequately justified main application as inadmissible (…)”, the message continues. According to the information, the AfD politicians had the application withdrawn immediately after the Constitutional Court announced in April that it would publish a decision by the Second Senate in a few days.
The AfD had filed lawsuits in Karlsruhe and at the Berlin Administrative Court at the same time. The administrative court confirmed the mask requirement in an urgent decision weeks later.
The mask requirement in the Bundestag has been in effect since October 6th. MEPs can, however, remove the mouth and nose protection when they have taken a seat – in the plenary hall and in meeting rooms – or are standing at the lectern. Several AfD MPs had demonstratively opposed the order. Schäuble relies on his house rules.
