According to the medical board, Lotocki used documents for the consent of the patient from the Argentine Society of Surgery of which he was not a part and there were alterations in the clinical history of the deceased businessman.
In the investigation, it was found that Cemeco was not prepared as an intensive care unit and Lotocki was not a specialist in general surgery..
Also, that in the previous studies it was not taken into account that Zárate suffered from type II diabetes and that there was no prior check-up to anticipate any outcome with that underlying disease.
The prosecutor charged Lotocki with felony felony manslaughter, considering that he represented that the patient could die and did nothing to prevent it.
The doctor Lotocki was already sentenced to four years in prison by the Oral Criminal Court 28 as a result of the serious injuries suffered by four patients who passed through his hands.
Lotocki was considered responsible for the crime of “repeated serious injuries on four occasions” and the victims and plaintiffs in the case were Gabriela Trenchi, Silvina Luna, Stefanía Xipolitakis and Pamela Sosa.
In addition to the prison sentence, Lotocki was given a five-year disqualification from practicing medicine and the request made by the prosecution to provisionally disqualify him until the sentence is final was rejected.
