As Federal President Alexander Van der Bellen announced, he has been informed by the judge. Private data was sorted out and destroyed in accordance with the order.
The Federal President thanks the responsible judge and the President of the Regional Court, Friedrich Forsthuber, as well as all those involved for the speedy settlement. This concluded the execution commissioned by the Constitutional Court, according to the presidential chancellery broadcast.
The starting point was a finding by the VfGH on March 3, in which it had granted the opposition’s request for files to be delivered by the finance department and requested Finance Minister Gernot Blümel (ÖVP), including the e-mail inboxes of the head of investment management in the finance ministry and correspondence from Ministry employees with the former ÖBAG boss Thomas Schmid, then Secretary General in the Ministry of Finance, and other employees of ex-Finance Minister Hartwig Löger (ÖVP) available to the committee.
Since Blümel did not comply, the opposition had requested the execution. The VfGH followed this request and commissioned Van der Bellen with the execution on May 5th. This did not happen for the time being, at that time Blümel immediately started delivering. From the point of view of the opposition, however, this delivery was incomplete and inadequate, which is why the opposition again turned to the head of state and Van der Bellen referred the Vienna Regional Criminal Court with the “enforcement” of the original VfGH ruling.
