Mendoza’s justice dictated house arrest to the comedian Juan “Cacho” Garayafter the prosecutor of the case extended the charge for the crime of sexual abuse with repeated carnal access and aggravated deprivation of liberty in the context of gender violence, judicial sources reported today.
The prosecutor Daniel Carniello today extended the imputation to “Chacho” Garay for the crimes of “sexual abuse with repeated carnal access and illegitimate deprivation of liberty aggravated by the relationship of a couple, all in real competition and in the context of gender violence”, and house arrest was ordered.
The comedian had previously been charged with the crime of “Illegal possession of a firearm and aggravated threats for mediating gender violence”after being arrested in the Mendoza town of Luján de Cuyo, due to a complaint from his wife.
Garay, after paying a bond, was released and an exclusion from the house, located in the aforementioned town, was imposed on him.
At that time, the defense lawyer stated about this action: “Mr. Garay was released, the necessary guarantees were offered and a bond was offered so that the prosecutor has the assurance of the accused in the process.”
The case advanced with new evidence and the prosecutor in charge of the investigation expanded the charge against the comedian and ordered him to be placed under house arrest in the case of gender violence.
The double imputation was added after some statements that the victim gave during a television interview, in which she said that the comedian forced her to have sexual relations with other people and that he used to hold her against her will, and that he had threatened her with death, Therefore, this element, together with others that the prosecutor had, added these two new charges.
Garay was apprehended at noon on April 12, in a house located on Calle 20 de Septiembre, within the framework of a raid ordered by the Gender Violence Prosecutor Unit and later transferred to Police Station 11, of the aforementioned town, about 17 kilometers from the provincial capital.
During the search, the police seized five firearms that were placed at the disposal of the Justice for its expert opinion, according to which two of them were fit for use and not declared; while the rest of the weapons were not fit for use.
The complaint came to light in those days, after the complainant’s lawyer, in interviews with Buenos Aires television media, said that the comedian’s wife decided to go to court after an episode of violence that occurred in a hotel in the Cordovan city of Carlos Paz.
On that occasion, the lawyer maintained that his client had to go to a women’s shelter, since her husband refused to leave the house they shared in Mendoza and indicated that he had been in a relationship with the comedian for 13 years and that he had been “victim of physical, psychological, economic and sexual violence”.
“It comes from a long period of suffering violence in every way”said the plaintiff lawyer Jose Manuel Fiz.
Before his arrest, Garay shared a message on his social networks in which he wrote, “Thanks to the thousands of messages of support. And thank God because my truth keeps my conscience crystal clear.”
The prosecutor charged him at that time with two crimes of “illegal possession of a firearm and aggravated threats for mediating gender violence” and after paying a bail of one million pesos, he was released until today, when he received two new accusations in the framework of the case of gender violence to the detriment of his ex-wife.
