The BGH has confirmed Alfons Schuhbeck’s prison sentence. However, how much money the star chef has to pay back has to be renegotiated.
The conviction of the famous star chef Alfons Schuhbeck (74) for tax evasion is “predominantly final” according to a decision by the Federal Court of Justice (BGH). The Regional Court of Munich I only had to renegotiate the skimming of Schuhbeck’s assets, . Accordingly, the regional court’s judgment was incomplete “because not all the information for calculating the defendant’s income tax liabilities had been determined.”
Nothing will change about Alfons Schuhbeck’s imprisonment
The revision of the prominent TV chef was largely unsuccessful. The BGH found no errors of law in the guilty verdict and sentencing. The decision of the Federal Court of Justice does not change anything about the imprisonment of three years and two months to which the district court of Munich I sentenced Schuhbeck in October 2022.
The Federal Court of Justice saw it as proven that Schuhbeck “daily withdrew cash from the tills of two restaurants, including the Südtiroler Stuben, totaling more than 4.2 million euros between 2009 and 2015”. Among other things, he used a computer program written by his employee to manipulate the sales.
Schuhbeck “evaded a total of more than 1.2 million euros in income tax,” as the BGH further announced.
