The Bavarian Supreme Court has overturned the verdict against Jérôme Boateng. A success for the professional footballer? That remains to be seen.

Boateng and his lawyers appealed – but so did the public prosecutor’s office. The Bavarian Supreme Court has now upheld both appeals. Boateng’s lawyer Leonard Walischewski argued that his client’s “right to a fair trial had been violated.” “The process was shockingly unfair,” he said. “The defendant Boateng was already finally convicted before the appeal process even began,” said Walischewski.
The public prosecutor’s office had appealed for other reasons. She wanted to seek a higher sentence for Boateng. Since both appeals were upheld, the proceedings went back to the Munich I Regional Court. There the process will be reopened.
A partial success
The overturning of the verdict is only a limited success for Boateng. His appeal was upheld, but so was that of the public prosecutor’s office. Now the process is being reopened. Once again, Boateng has to comment on the allegations that he was violent towards his ex-girlfriend. “It is once again a factual instance. That means: all witnesses are heard, evidence is reassessed, the cards are reshuffled. The outcome is open,” explains the criminal law lawyer, Dr. Alexander Stevens, dem star.
“It can end in an acquittal for Boateng, but it can also get worse for him.
