They ordered the arrest of Aníbal Lotocki for the death of Cristian Zarate. The decision was made by Chamber IV of the Court of Appeals, which yesterday confirmed his prosecution for homicide.
The doctor is being investigated for the death of the businessman Rodolfo Cristian Zárate which occurred on April 16, 2021 during a surgical intervention that Lotocki had performed to reduce fatty tissue.
Lotocki is accused of the crime of “simple homicide due to possible intent”. According to the judges Ignacio Rodríguez Varela, Julio Lucini and Hernán Martín Lópezthe doctor’s conduct “was indisputably the determining cause” of death, “which would not have occurred if he had not performed surgery” on Zárate.
At the beginning of the process, the case had been classified as manslaughter, but after the prosecutor’s request Pablo Recchinithe City magistrate modified the criminal classification to simple homicide with prison sentences ranging up to 25 years in prison.
The court ordered the arrest given the seriousness of the crime and the risk of flight and obstruction of the investigation. Now Lotocki’s defense will have the possibility of appealing the measure.
The death of Cristian Zárate
Zárate had surgery on April 15, 2021 at the Cemeco Clinic in the City of Buenos Aires. Lotocki performed a scheduled dermolipectomy, which consists of removing tissue in different parts of the body.such as “neck, shoulders, pectorals, arms, armpits, anterior abdomen, pelvis, lumbar region, and glutes.”
Lotocki explained that the patient was moved to a room, but “the drainage was releasing a large amount of ‘liquid’ (sic) from the body, and he was ordered to enter the operating room again”. The doctors decided to transfuse him with blood and call an ambulance to transfer him to a more complex center.
During that interval “they began resuscitation maneuvers on Zárate”, who had gone into cardiac arrest, and died before being transferred. Pre-surgical studies revealed that the 50-year-old businessman had suffered from coronavirus and suffered from Diabetes Mellitus II.
