The doctor Aníbal Lotocki He spent his first night detained in the Buenos Aires district of Ezeiza prison, while his lawyer insisted that his client’s detention “has no basis” and that, therefore, they are going to “question the resolution” adopted by the justice system.
This is what the lawyer said Diego Szpiegiel, who pointed out that the arrest warrant issued on Lotocki in the context of the case in which the doctor is accused of “simple homicide” for the death of the businessman Rodolfo Cristian Zárateoccurred in 2021, “he has vices that are insurmountable”.
After having surrendered last Wednesday in the city of La Plata, Lotocki was transferred to the Mayor’s Office of the Superintendence of Investigations of the Argentine Federal Police (PFA), located in Madariaga and General Paz, in the Buenos Aires neighborhood of Villa Lugano, and, before the end of yesterday’s day, He was transferred to the Ezeiza prison complex, where he spent the night.
“The procedural steps that we are going to adopt are to question the resolution of the Chamber of Chamber IV (of the appeal court) so that it is null and void given that it has defects that are insurmountable,” said the lawyer who sponsors Lotocki, in dialogue with Télam.
“The judges’ jurisdiction was to decide whether they confirmed or revoked the resolution in the case (of Uruguayan actor Raphael Dufort), but in that context they decided to revoke a release in the Zárate case, which is in another file,” the lawyer argued.
In this context, Lotocki’s defense lawyer stated that “the question is whether the Chamber has the power to revoke in a file something that has to do with another (file).”
As part of his case, Dufort, who suffered serious health problems after being operated on by Lotocki, had requested last month the arrest of the doctor who was
“(The judges) maintained that there is a risk of flight. They are absolutely wrong because (Lotocki) found out about the resolution (of arrest) at 2 p.m. and at 4 p.m. he showed up at the Argentine Federal Police station to show that he is absolutely at the disposal of justice,” Szpiegiel said.
“Whenever he is summoned he will appear and mainly, even if it is to serve a detention, he will come voluntarily. His will always is, was and will be subject to the process,” added the lawyer, who understood that the detention “only seeks have a media effect because, from a procedural point of view, it has no basis”.
Yesterday, when evaluating the risks of the accused remaining free, judges Hernán López, Ignacio Rodríguez Varela and Julio Luciani maintained that the desire to hinder the investigation was evident “due to the evidence already provided by the falsification of the medical history” of Zarate.
What was the death of Rodolfo Cristian Zárate like?
Zárate underwent surgery at the Cemeco Clinic to undergo a scheduled dermolipectomy, which consists of the removal of tissues in different parts of the body.
After the operation, after being transferred to a room, as Lotocki explained, “the drainage released a large amount of ‘liquid’ (sic) from the body, and he was ordered to enter the operating room again.”
Faced with this situation, the doctors decided to transfuse him with blood and call an ambulance to transfer him to a more complex center, but in that interval “they began resuscitation maneuvers for Zárate” because he had gone into cardiac arrest, and before being transferred he died. .
The surgeon was sentenced to four years in prison and disqualified from practicing the profession for serious injuries committed against several patients.including the model and host Silvina Lunawho died in the Italian Hospital on August 31, but remains free for that reason because the sentence has not yet been confirmed by the Criminal Cassation Chamber.
