The legal problems of Kevin Spacey they still continue. The actor will face a civil trial in the UK after being sued by a man who alleges Spacey sexually assaulted him.
The man, who was granted anonymity by the court, claims he “suffered psychiatric damage and other financial losses” as a result of the alleged sexual assault, which he claims took place in August 2008.
The trial date has not yet been confirmed, but the documents are scheduled to be exchanged in early 2025.
The actor’s legal team returned to court Tuesday morning to vacate a default judgment in favor of the plaintiff after Spacey’s attorneys failed to file their defense on time. Spacey did not attend.
Calling the lawyers’ error a “blunder,” Judge David Cook reluctantly agreed to annul the sentence to “avoid injustice.”
The lawsuit against Spacey
The civil lawsuit, which was filed in July 2022, was suspended until the outcome of the criminal trial. Last summer, Spacey was cleared of wrongdoing in criminal courts after a jury found him not guilty of nine charges, including sexual assault and indecent assault, following accusations by four men.
Spacey’s attorneys should have presented their defense after the conclusion of the criminal trial, but did not do so due to a “genuine mistake,” his lawyer said in court.
Had the judge denied the request, the case would have proceeded to a compensation hearing to quantify how much the plaintiff should be awarded.
Noting that the lawyers had made a “serious and significant” error, the judge said that “in my opinion, that error should not fall on the defendant.”
“The interests of justice demand that the accusations proceed to trial and the default judgment be set aside.”
