Criminal case against Alec Baldwin dropped: Family of Halyna Hutchins continues to fight

Alec Baldwin will not be prosecuted in the “Rust” tragedy. Halyna Hutchins’ family still wants to keep fighting.

The lawyer for the family of Halyna Hutchins (1979-2021) has announced that the relatives of the killed camerawoman want to continue fighting for justice. According to US media reports, she said that the discontinuation of the criminal case against Alec Baldwin (66) for negligent homicide “only encourages us to seek justice in the civil case”.

apparently in front of the courthouse in Santa Fe after Baldwin’s case was dismissed by Judge Mary Marlowe Sommer: This only strengthens “our resolve to do justice in the civil suit we filed against him in Santa Fe, New Mexico.” Allred represents the parents and sister of the deceased camerawoman.

Halyna Hutchins was fatally injured in October 2021 on the set of the film “Rust” by a bullet from a gun held by Baldwin. The gunsmith responsible on set, Hannah Gutierrez-Reed (27), was sentenced to 18 months in prison for negligent homicide in April. Why the gun was loaded with live ammunition remains unclear to this day.

Family wants to fight “to the end”

Attorney Gloria Allred said that the news of the dropped criminal case against Baldwin was “devastating for the family” who mourn Halyna every day and that she intends to “fight to the end.” According to media reports, the attorney also stated that she was “determined” to hold Baldwin and the entire “Rust” production accountable in the civil suit, which, she further noted, was not affected by the court’s decision in the criminal case.

Allred does not represent Halyna Hutchins’ widower, Matthew Hutchins, who settled a lawsuit he filed in 2022. He said he believed his wife’s death was a “terrible accident,” according to media reports.

The trial against Alec Baldwin was terminated due to a procedural error. The judge ruled on Friday (July 12) that the prosecution had intentionally withheld evidence from Baldwin’s defense. This leaves the court with only one possible response: to immediately dismiss the case. This means that Alec Baldwin cannot be held responsible for the fatal shot in any new criminal proceedings. He faces up to 18 months in prison. Possible civil lawsuits are, however, exempt from this.
