Insurance Case: Cassation will analyze the lifting of Alberto Fernández’s property inhibition

Room IV of the Federal Court of Criminal Appeals will review, after the complaint from the Public Prosecutor’s Office, whether or not the lifting of the general inhibition of assets against Former President Alberto Fernandezordered by the Federal Court of Appeals.

But finally, and after the appeal of the defense, the Federal Court of Appeals of Buenos Aires with the vote of judges Boico and Farah ordered the lifting of the measures.

Faced with this situation, the prosecutor of the Court filed an appeal and, when it was denied, he complained to the Federal Court of Cassation. Now, judges Gustavo M. Hornos, Javier Carbajo and Diego G. Barroetaveña decided to grant the request of the prosecutor and They will decide whether or not the sanction should be lifted.

To do this, they must set a hearing in which They will hear both the claims of the prosecutor and those of the defendants’ defense.

What is Alberto Fernández accused of in the Insurance Case?

This case investigates the possible existence of a criminal organization that would have operated in the contracting of insurance by various state entities during the presidency of Alberto Fernández.

In particular, the focus was placed on Decree 823/2021, by which the former head of State imposed the obligation on the State Public Sector to contract insurance services exclusively with the company ““Nation Insurance SA”.

The complaint is for alleged violation of the duties of a public official and abuse of authority and misappropriation of public funds. However, since the case is in the procedural stage, the qualifications are provisional.
