The intervention of ARICCAME seeks to reorganize and optimize the management of the body in charge of regulating the medicinal cannabis and hemp industry in Argentina. According to the Decree, in order to improve its efficiency and respond to the growing demand of the sector.
The Government decreed the intervention of the Hemp and Medicinal Cannabis Industry Regulatory Agency (ARICCAME)This body was created by law 27.669 and its main objective is to regulate the production and marketing of cannabis and its derivatives for medicinal and industrial purposes throughout Argentina.
In this way, the Government is moving forward with changes in the regulation of the cannabis industry. It should be remembered that at the end of August the Ministry of Health introduced changes to the medicinal cannabis regime. Among the new changes are new registration requirements and specified the permitted ranges of flowering plants grown by licensed persons.
Now, the agency justifies ARICCAME’s intervention by stating that the agency is not achieving the objectives established for its creation, presenting problems such as a lack of personnel, cumbersome administrative procedures and delays in the issuance of licenses. It maintains that the private sector has a great demand for the agency’s services, and the entity does not have the necessary structure to attend to it efficiently.
For this reason, the Decree 833/2024 Published this Wednesday in the Official Gazette, it seeks to simplify procedures, unify administrative procedures and improve access to information.
What are the main measures of the decree?
- Appointment of an auditor: An intervenor is appointed with broad powers to restructure the agency, review procedures and make decisions.
- Limitation of functions: the functions of the previous director of ARICCAME are limited.
- Broad powers of the intervenor: The receiver has the power to reorganize the agency’s structure, review programs and projects, manage human resources and grant licenses.
- Intervention period: The intervention will have an initial duration of one year, with the possibility of extension.
According to the official text, the main objective is to reorganize and strengthen ARICCAME so that it can efficiently fulfill its function of regulating the cannabis industry. The aim is to streamline procedures, improve transparency and ensure compliance with current regulations.
