The courts have suspended the essentiality of the air transport service

The Justice suspended, by means of a precautionary measurethe application of the decree which declared as “essential” to the air transportafter a presentation of the Airline Pilots Association (APLA).

It was through a resolution of the Labor Court No. 42in charge of Ricardo Hierrezuelowhich ordered the suspension of the Decrees 825/24 and 831/24.

Within the framework of the wage dispute with Argentine Airlinesthe government declared air transport service “essential”.

What the union says

According to the union, the resolution states that “the claim made by APLA has been duly accredited, in accordance with constitutional, legal and regulatory norms.”

They also added that the right to strike “is found expressly recognized in our country since the incorporation of the art. 14bis of the CN in the year 1957as well as in the art. 8 of the International Covenant on Economic, Social and Cultural Rights and ILO Convention 87 which has constitutional hierarchy.”

With this, they maintain that “the law remains valid” art. 24 original of law 25.877 and the Regulatory decree 272/06civil aeronautical commercial activity not being among the essential services listed.”

What the pilots say

For their part, the pilots They point out: “As evidenced by the ongoing conduct of APLA, always within the framework of the Rule of Law, we will respond to each illegality with greater conviction about the reasons for our claims“.

They also warned that “the Governmentwith each measure with which gets involved in the conflict repeatedly makes it clear that it is part of it and, with it, confusing its role as a public authority with that of an employer or, even worse, with interests other than those of the National State and public assets, scandalously violating current regulations and determining responsibility for it.”
