This reform, published today in the Official Gazette through DNU No. 941/2024was promoted by the Ministry of Transportation of the Ministry of Economy and the Ministry of Deregulation and Transformation of the State and modernizes the existing regulations by aligning them with the recent international auditing standards, required by the International Civil Aviation Organization (ICAO) and the Federal Administration of the United States Aviation Authority (FAA).


From Transportation they indicated: “With this reform of the Aeronautical Code, Argentina completes and resolves 100% of the legal observations that had been identified by the inspection of the Federal Aviation Administration of the United States (FAA) last April, after decades of terrible performance that led to the need for the aeronautical authority to intervene.” However, they clarify that “although all the required legal observations are completed, they still need to evaluate, within the framework of this inspection, “other areas of an eminently technical nature such as operations and airworthiness that will be audited in the coming days.”

The modifications introduced in the Aeronautical Code
- The incorporation of the powers of the aeronautical authority in the “Generalities” section of the Codeaccording to common law. At the same time, it is clearly established that the ANAC is empowered to regulate the Technical Annexes of international Conventions.
- The incorporation of an article that deepens the notion of delegated authority. This means that The ANAC may authorize third parties, natural or legal, to carry out evaluations, certifications and inspections. To do this, they must meet certain requirements and the procedures under which they will supervise the performance and fulfillment of the task delegated to them will have to be established.
- The specific authorization to the ANAC to preventively stop or impede the flight of an aircraft for operational safety reasons.
- The specific strengthening of the figure of the aeronautical inspectors, that will be enabled to carry out inspections of all air operators, as well as public and private entities in the aeronautical field. At the same time, they are granted preventive powers, being able to suspend activities of aeronautical personnel when they detect that they do not comply with the procedures and standards. In these cases, the inspector may retain the staff’s license until it is proven that the necessary corrective measures have been taken.
- The express incorporation of the two branches of civil aviation: commercial and non-commercial.
They point out that “from this new reform of the Aeronautical Code, which complements the first, Argentina is aligned with the highest regulatory standards, according to the main international audits“.
However, they maintain that “the National Government will continue working to regularize other operational areas that were far below international standards and that were also identified by the audits, due to the laziness and lack of management of the aeronautical system by of previous administrations”.
