The conflict between the Government and universities advances in the field of audits. The UBA had presented a precautionary measure to avoid the participation of the General Audit Office of the Nation.

Universities and the Government add a new chapter in the conflict over university financing and audits on the funds received by study houses. Now, the General Sindicature of the Nation (SIGEN) demanded that the precautionary measure requested by the UBA to avoid being audited by that organization.

In detail, the state agency presented a report answering the lawsuit before the Justice, in addition to challenging the judge in federal administrative litigation without cause, Diego Cormick. Given this decision, the magistrate sent the file to the Federal Administrative Litigation Chamber for a new court draw.

The response of the SIGEN to the precautionary measure of the UBA

As detailed by SIGEN in the document presented to the Court, “it is evident that the issuance of the requested precautionary measure“in the demand of the University of Buenos Aires “it would compromise the public interest irreversibly, by directly affecting the fulfillment of constitutional objectives, such as the due control of public funds.”

“Auditing is not intervening, it is verifying the financial economic management of an entity whose purpose is to add value and improve the operations of an organization, while at the same time accounting for the public resources used and providing transparency in state management“, they maintained from the organization directed by Miguel Blanco. In this sense, they ruled: “prevent SIGEN from auditing the funds that the National Treasure turns to the UBAfor the fulfillment of its functions, implies causing serious damage to the public interest with irreversible effects, because it would leave the application of the vast resources assigned to that house of studies that have not yet given up“.

In addition, the organization clarified that “the audit excludes study plans and other income that the university may have from its own activities and does not generate any cost for it.” The report that the magistrate had requested with a period of five days was presented by Blanco with the legal sponsorship of the head of the Attorney General of the National Treasury, Rodolfo Barra.

The precautionary request

The UBA presented, on October 28, a “declaratory action of certainty” for the Justice to define whether the SIGEN You may or may not audit it. While this issue is being resolved, the higher house of studies also requested that a precautionary measure be issued to prevent this.

In the document of claim, the precautionary measure was requested to order the National Executive Branch and SIGEN to “refrain from carrying out any type of action linked to interventions at this University, under the name of audits and/or any other name that implies internal control”. This request comes in the midst of the conflict between the Government and the universities and the demand to move forward with audits of the funds received by educational institutions.

In detail, the UBA warned that the libertarian administration “unilaterally decided to carry out an audit starting next October 28, lacking the authority to do so“. In the document presented, the lawsuit seeks that Justice “declare the unconstitutionality of art. 8 of Decree 1344/07 and the incompetence of the SIGEN to exercise the internal control of this University as they are contradictory and incompatible with the norms, principles and guarantees of the National Constitutional Law.” Given this presentation, the judge in federal administrative litigation, Diego Cormick, stipulation a period of five days for SIGEN to produce the report – presented today – in response to the UBA’s arguments.
