The government of Javier Milei officially announced that kiosks will be able to sell medicines againsomething that was exclusive to pharmacies. This regulation was specified through the Decree 1024/2024 published in the Official Gazette.
Through this determination, it is established that Over-the-counter medications may be displayed on shelves inside pharmacies.. Nevertheless, some conditions must be strictly followedlike they should be in a closed box and with a leaflet.
Furthermore, its sale will be exclusively for people over 18 years old with prior mandatory validation of the National Identity Document (DNI).
For its part, in the businesses that are not authorized as pharmaciesthe sale will be restricted only to antacids and pain relievers. Likewise, the measure does not rule out that the enforcement authority may expand this list of permits in the future.
What about prescription medications?
The rule decreed by the Government also establishes that Prescription medications may only be sold in authorized pharmacies.and with the supervision of a pharmacist who will be responsible.
Likewise, the measure adds that it allows the marketing of prescription medicine through secure and approved electronic channels.

Kiosks will once again sell over-the-counter medications.
In this way, the resolution establishes: “The sale and delivery of medical specialties that require prescriptions must be carried out from the pharmacyin the presence of a responsible pharmacist (Technical Director and/or assistant pharmacist)”.
“Its sale and delivery to the patient may be agreed upon through electronic channels determined by the pharmacyby transfer to the place that it has at its convenience, ensuring that the transfer is carried out safely in accordance with the applicable requirements and those that the Health Authority establish for this purpose,” he adds.
According to the ruling party, what is sought with this legislation is optimize marketing conditions of medicines, in addition to protecting consumers.
To achieve the latter, it ensures that all products maintain unaltered its physicochemical properties and be accessible in a framework of security and transparency.
Sale of over-the-counter medications
- Gondola display: These medications can be displayed directly on pharmacy shelves, facilitating consumer access.
- Restrictions: They must be in a closed box, with their leaflet and can only be sold to people over 18 years of age.
- Other establishments: the sale of some over-the-counter medications (antacids and pain relievers) is allowed in establishments that are not pharmaciesbut ANMAT can expand this list.

Finally, he maintains that the decree seeks to achieve a balance between facilitating access to medicines and guaranteeing consumer safety.
