A new regulation limits access to citizenship for descendants of Italians in Argentina.
Italy has implemented new restrictions that complicate access to Italian citizenship for many Argentines. The most important modification is found in Circular No. 43347, which establishes more rigorous requirements for those seeking to obtain Italian nationality by descent.
Now, Argentines with Italian ancestry must comply with stricter conditionsespecially if their ancestors were naturalized in Argentina before they came of age. Below, we explain how this change affects those who wanted to emigrate or regularize their situation.
Italian citizenship: this is what it was like before and this is what the process is like now
Before the reform, any person born outside Italy, but with Italian ancestry, could obtain citizenship automatically, under Law No. 91/1992. This process was based on the principle of “ius sanguinis“, that is, the right to citizenship by bloodwhich allowed any child of an Italian to have the right to nationality, regardless of which country they were born in.
However, with the change in regulationsit is now required that the Italian descendant has not lost his or her nationality through the naturalization of the father or mother in another country before the child reaches the age of majority. If the father or mother became Argentine naturalized while the child was still a minor, the child no longer has the automatic right to Italian citizenship, although he or she can begin the process up to the age of 22.
