Marius Borg Høiby had to be in custody for a week. What considerations led to the decision – and what the responsible judge had doubts about.
Crown Princess Mette-Marit’s son, Marius Borg Høiby, is allowed to leave custody today. “We currently no longer see any danger of evidence manipulation,” the court said. The subject of the court hearings were two rape allegations. The 27-year-old denies both allegations.

Documents that the court has now made public and which the Norwegian media quote show that the judge responsible had doubts about the second accusation. The alleged “sleep rape” is said to have taken place at the end of September in Marius’ apartment in Skaugum, the residence of the crown prince family.
The judge’s doubts were based on the fact that the police had not yet interviewed the woman. According to Borg Høiby, he has known the woman for a long time and had consensual sex with her. The police demanded two weeks of pre-trial detention due to the two allegations, but judge Anne-Lene Åvangen Hødnebø did not see this as justified. “The court’s doubts are based on the fact that the woman has not yet made a statement about this,” the decision states.
The first case discussed was an alleged sleep rape that was said to have occurred in April. The alleged victim was not conscious. The Norwegian “Dagbladet” reported that it was “hard” for the woman affected. It wasn’t she who reported Mette-Marit’s son, but rather the police after they found a video of the alleged crime on the 27-year-old’s cell phone.

Borg Høiby is suspected of violating a criminal law section “concerning sex with a person who is unconscious or otherwise unable to defend themselves,” Norwegian police said. He denies the new allegations, as his lawyer Øyvind Bratlien told several Norwegian media outlets. The scandal has been bothering the royal family for months. In August he is said to have “mentally and physically” attacked a girlfriend and vandalized a room. The woman called the police after the incident and had to go to the hospital with a concussion

According to their own statements on Wednesday, the police did not apply for an extension of the pre-trial detention, although the investigation now involves a third case. The police did not disclose details of the new accusation against Høiby.
