The Ministry of Human Capital established through National Institute of Associativism and Social Economy (INAES) a new requirement for the constitution of work cooperatives and the provision of services for rural producers. With this new regulation, it will be necessary to have a minimum of six associates to form this type of entity.
With this measure, a flexibility implemented in 2021 is reversed, which allowed the creation of cooperatives with so only three or five members.

As indicated in a statement, “by establishing a minimum number of associates, greater participation and commitment of the members is promoted, which translates into more solid and sustainable management of cooperatives”.
What will the exceptions and adaptation of existing cooperatives be like?
Now, INAES will be able to evaluate exceptional requests for the constitution of cooperatives with less than six members in specific cases. As indicated, “Those linked to IT, cultural or care activities will be prioritized, as long as the viability of their operation with a smaller number of members is demonstrated.”
For their part, cooperatives that were established with three or five members They will have one year to adapt to the new regulations and reach the minimum of six members.
However, they also clarified that those dedicated to computer, cultural or care services They may request an exception to this requirement, which will be subject to evaluation by INAES.
