The Argentine official emphasized that “the case of the Argentine citizen Nahuel Gallo is a compelling proof of the serious violations of international law and fundamental human rights that you endorse from your position”.
Along these lines, he stressed that his “empty rhetoric and unfounded grievances” will not be able “hide the seriousness of this case or justify the atrocities that he legitimizes from his position.”
In relation to the case of gendarme Gallo, who entered Venezuela on December 8 to visit his family and was detained by the Venezuelan authorities, Werthein warned that keeping him in these conditions “with false accusations, incommunicado, Denying him consular access and legal assistance constitutes a direct violation of the Vienna Convention on Consular Relationsspecifically Article 36, which guarantees the right of foreign citizens to communicate with their consulate and receive protection.”
In that sense, he maintained that the irregular detention of the Argentine constitutes “a forced disappearance, a crime against humanity recognized by the Rome Statute of the International Criminal Court.” “I remind you that crimes against humanity do not prescribe. Those responsible for these violations face the scrutiny of international justicewhich acts beyond the borders and narratives that you try to build,” he added.
Finally, he demanded on behalf of the Argentine government the “immediate release of Nahuel Gallo; immediate and unrestricted consular access, in accordance with the Vienna Convention; provision of proof of life that certifies his physical integrity, and guarantees of legal assistance and contact with his family”. He warned that the case “will be taken to all necessary authorities until his release is guaranteed” and assured that they will “demonstrate that human rights violations will not go unpunished.”
The Public Ministry of Venezuela targeted Werthein and Bullrich
