Legal dispute over income from Til Schweiger’s cinema hits ends

For years, the screenwriter Anika Decker argued with a higher participation in income from the films “Keinohrhasen” and “two -ear chicks”. According to the law, this is possible. But her lawsuit was late.
The legal dispute over a higher participation of the screenwriter Anika Decker in the overall revenue from Til Schweiger’s cinema hits “Keinohrhasen” and “two -ear chicks” has ended. Decker withdrew her appeal against the judgment of the district court of 2023 on Monday before the Berlin Chamber Court, as a court spokeswoman said on Tuesday.
In September 2023, the regional court generally granted Decker to a significantly higher participation in the millions of cinema hits – but considered a large part of its claims to be statute -barred. With its withdrawal of the appeal, this judgment is now final. The “Frankfurter Allgemeine Zeitung” and the “Süddeutsche Zeitung” had reported.
Years of fighting courts
Screenwriter Decker had fought for higher participation for years. According to the court, she originally asked for more than two million euros from the production company and rights holder Barefoot Films and the media group Warner Bros.
According to the judgment of the regional court, she is entitled to a total amount of around 180,000 euros by 2020. She also has a low claim at later income from 2021.
However, it does not receive anything of the million sums of the initial cinema evaluation because, according to the judgment of 2023, she had sued too late and expired her fundamentally existing claims. Decker had argued that such complaints in the film industry were very difficult to complain of successful companies and producers and could at least endanger careers.
“Fairnes paragraph” in copyright
The regional court judgment was based on the “Fairnes paragraph” in copyright. He provides for a post -payment if the originally agreed fee and the later income are striking mismatch. From the court’s point of view, this was the case in this case. “Keinohrhasen” was the most successful German film in the cinema in 2008. Millions of visitors later also attracted “two -ear chicks”.
