Processes: Lehmann has to pay 1,000 euros after alcohol ride

The Munich District Court sentenced the former national goalkeeper Jens Lehmann to a fine of 1,000 euros for an alcohol trip to the Oktoberfest. In the end, his “bad behavior” benefits him in court, as judge Möhring says in her reasoning. Because that he had acted unobstructed and without a distance towards police officers, and it was uncooperative when taking blood for alcohol control, this was out of the question for them.

However, this did not necessarily have to be on the two and a half liters of beer, which Lehmann, as he admits, had drunk at the Oktoberfest that evening. After the hours of negotiation, the judge states: “You would have behaved similarly when it comes to sober condition.”

The 55-year-old had repeatedly spoken out in court. And because he also photographed one of the police officers on the sidelines of the process, the judge complained: “Self -justice has never been a good idea.”

The policeman stated that Lehmann had photographed him in the court before his testimony and asked him if he had children-and asked the judge to ask the 55-year-old to delete the photos. Because he stated that he had already done this, the public prosecutor’s office refrained from asking for Lehmann to publish his cell phone. The policeman said he didn’t think Lehmann wanted to show the photo of him to his own children.

Over 0.7 per thousand alcohol in the blood

The fact that alcohol was caught with over 0.7 per thousand after the Oktoberfest after the Oktoberfest, the court also evaluates abnormal behavior because of its sober state as an administrative offense. Because Lehmann has already served the driving ban imposed by one month, he even gets his driver’s license back immediately after the court’s decision. The public prosecutor had originally accused a criminal offense for driving inability and set a fine in a criminal order, but had already deviated from this demand in the final plea. According to Lehmann’s defender, the fine was 72,000 euros. Because Lehmann had filed an objection to this penalty order, the trial before the district court, in which he was now able to save 71,000 euros.

At the beginning of the trial, Lehmann had admitted that he got into the car and dangers. “In the course of the evening I drank two beer, two measures, and maybe also a acidic” – a beer with water. “I drove because I was assuming that I could drive,” he emphasizes. “I made a mistake in this regard, which I also regret.”

“I don’t choke – and certainly not to two dimensions”

However, he was not drunk, had no symptoms, did not fill up and didn’t have to choke. According to the public prosecutor, he was uncooperative during the subsequent police control and showed “mood swings”. He had “a washed -out pronunciation” and “a leap -in thinking process”. For example, Lehmann pulled his arm away to defend himself against the blood sample. It was not the first time that the former national goalkeeper and World Cup hero from 2006 were on trial. It was only last year that he was legally sentenced to finance due to property damage with a chainsaw on a neighboring property.

Even then, Lehmann had tried an alleged celebrity malus and said that he felt treated unfairly. In a similar way, his defense lawyer expresses himself in a similar way: he criticized a “massive, punishable and ruthless violation of the accused’s personal rights” because information about the incident became public shortly afterwards.

The judge says his conspicuous behavior in her reasoning, which Lehmann was actually actually coming up this time. But she hopes that he will take the trial against him as an opportunity to ask himself whether he really wants to present himself like this: “I don’t think she will continue in the long run,” she said, “that she, Mr. Lehmann, as a former goalkeeper, must adhere to the laws”.
