Randy McGinnthe estate’s attorney in Albuquerque, said she expected the case to go to trial within a year and a half to two years, which she said is relatively fast.
“We’re used to people coming from out of town to play cowboy who don’t know how to use guns,” McGinn said. “You don’t give someone a gun until you give them safety training… No one should die with a real gun on a fictional movie set.”
In addition to Baldwin, the lawsuit names seven producers as defendants: Ryan Smith, Allen Cheney, Nathan Klingher, Ryan Winterstern, Anjul Nigam, Matthew DelPiano Y Emily Salvasonas well as team members Sarah Zachry, Dave Halls, Hannah Gutierrez Reed, Gabrielle Pickle, Seth Kenney and others.
The Santa Fe County Sheriff’s Office has been investigating the incident, focusing on determining how a live bullet made its way onto the set. Search warrants have revealed that the gunsmith, Reed Gutierrez, loaded the Colt .45 with what she believed to be fake bullets. He then gave the gun to Halls, the first assistant director, who proclaimed it to be a “cold gun” as he handed it to Baldwin.
Three other team members have already filed a lawsuit: Mamie Mitchellthe script supervisor; Serge Svetynoy, the technician; Y Cherlyn Schaefer, the key doctor. Reed Gutierrez also sued Kenney, who supplied ammunition to the set, alleging that he mixed real and dummy ammunition. The production had a civil liability policy with a limit of US$6 million.
In response to Mitchell’s lawsuit, the producers, including Baldwin, have argued that the case should be dismissed because it involves a workplace accident, which must be handled through the state workers’ compensation system.
