The Justice decriminalized abortion until the 24th week of gestation

The “conduct of abortion will only be punishable when it is carried out after the twenty-fourth (24) week of gestation and, in any case, this time limit will not apply to the three cases established in Judgment C-355 of 2006”, the Court specified in a statement.

The feminist group Causa Justa filed a lawsuit to eliminate the crime of abortion, however, the decision of the Court was not the total decriminalization of the interruption of pregnancy, but to draw a line of temporality.

Since 2006 in Colombia, women can abort in three cases: when the pregnancy represents a risk to her life, when the fetus has serious malformations or her life is unviable, and when the conception is the result of rape.

In its decision, the Court urged Congress and the Government to “in the shortest possible time” establish a “comprehensive public policy” that “avoids wide margins of lack of protection for the dignity and rights of pregnant women” and “protects the legal interest of life in gestation without affecting such guarantees”.

The director for the Americas of Amnesty International, Erika Guevara-Rosasuploaded a video on social networks in which a group of women is seen celebrating the announcement in front of the headquarters of the Constitutional Court, in Bogotá.

“Let’s go for more, the green tide is unstoppable, thanks Colombian sisters,” he said.

Jose Miguel Vivancoformer director of the Americas Division of Human Rights Watch, for his part celebrated the “good news” and recalled that Argentina and Mexico also decriminalized abortion.
