The best legal protection enjoy package travelers – at least that is what many vacationers think. “However, tourists are often unclear about how many and above all what rights they actually have as a package traveler and some are not really aware that their booked vacation is actually a package tour,” explains Nikolaus Authried from ÖAMTC legal advice.
Criteria of package tours
“For package tours, at least two of the following four travel services have to be combined in one contract: promotion, accommodation, car rental and other tourist services,” explains Authried. For example, concert tickets or ski passes include “other tourist services”. According to the ÖAMTC lawyer, this type of performance must have been used to make a significant share in the total value (25 percent or more) or have been advertised as a “essential feature” of the travel combination. Cruises are always considered a package tour.
