The 66-year-old is said to have driven towards an opponent in the course of an argument that escalated under the influence of alcohol. The prosecution sees in fact an attempted murder. The man’s two sons, who are said to have stood by his side, are also accused. Overall, several people were injured in the incident.
The main defendant was driving that day with 0.92 per mille intus. In Ottnang (Vöcklabruck district) he had a dispute with a drunk pedestrian from the car. When he leaned into the vehicle, the 66-year-old is said to have stepped on the gas and dragged the other about 60 meters. Then he is said to have approached his opponent again and shouted “I fia di down!”, but crashed into a traffic sign.
Sons are said to have attacked “opponents”.
The 66-year-old pleaded not guilty and presented himself as a victim. The drunken night owl called him “shit Jugo” – he admitted that that could have been the case – and hit him that he was just “with life escaped”. He doesn’t want the other person to be dragged along, rather he “clings to the car”. He also did not approach him, but drove up to the traffic sign while intoxicated.
According to the public prosecutor, this incident was followed by the “second act” of the cause: the 66-year-old had summoned his two sons, aged 25 and 28, who had been convicted several times. The younger Filius is said to have uttered wild threats against several people present at the crime scene and injured two police officers. The older man is also said to have injured an officer and also jumped twice with stretched legs against other people – he missed a man, one suffered a femoral neck fracture. The two sons pleaded not guilty or only partially guilty. They claim to have been attacked and beaten themselves and that the witnesses for the prosecution had coordinated this at the scene of the crime.
The Wels public prosecutor charged the 66-year-old with attempted murder and attempted bodily harm. The 25-year-old is accused of dangerous threats, resistance to state authority and serious bodily harm, the 28-year-old of serious and deliberately serious bodily harm and also resistance to state authority. A verdict is expected in the evening.
