As envisaged in the expert commission’s report, the obligation to vaccinate is temporarily suspended. Health Minister Johannes Rauch (Greens) and Constitutional Minister Karoline Edtstadler (ÖVP) informed about this after the Council of Ministers on Wednesday. With the postponement of the vaccination requirement, there will be no penalties for the time being. In three months should be evaluated again, said Rauch.
Originally it was planned to punish unvaccinated people from March 15th. The so-called “phase 2” in the compulsory vaccination law provided for that. But nothing will come of it – at least for the time being. “We follow what the commission proposes,” said Edtstadler on Wednesday. The obligation is not proportionate to the prevailing Omicron variant.

Checks would be planned from March 15th
The government’s phased plan would have provided for the unvaccinated to be punished from March 15th. In this so-called phase 2, the police should check the vaccination certificate as part of their checks and report a violation to the district administration authorities. In phase 3 (without a specific date) there could then be an automated data comparison in order to identify the unvaccinated in principle.
In addition to the two physicians Eva Schernhammer and Herwig Kollaritsch, the compulsory vaccination expert commission also includes constitutional and medical law expert Karl Stöger and legal scholar Christiane Wendehorst.
