Taliban trial in Wels: verdict partially overturned

Taliban trial in Wels: verdict partially overturned

The guilty verdict of attempted murder and dangerous threats remains, but not those of terrorist organization, criminal organization and incitement and condoning of terrorist offenses.

The Afghan had served 15 years in prison in September last year. He called for the killing of a woman in the United States after she burned the Koran, according to a video. He also threatened the woman. The court considered this to be proven and the Supreme Court also rejected the defendant’s appeal for nullity on these points.

Punishment could be recalculated

However, the situation is different with regard to the terrorist association, criminal organization and request for and approval of terrorist offenses: Here the OGH saw deficiencies in the findings. He overturned the verdict of the jury and referred the case back to the regional court in Wels for another hearing. This could also mean that the sentence of 15 years should be recalculated.

Call for murder denied

During the trial, the accused denied calling for the murder of an alleged doctor, but admitted glorifying the Taliban. However, he claimed that he made videos out of anger but didn’t upload them to his social media account, instead deleting his entire profile. However, the videos were recorded live and went viral via a “fake account” by an unknown third party, according to the defense line.
