Cobra affair: File was sent to the WKStA

Further information could not be given. First of all, the decision of the WKStA has to be awaited as to whether it will take over the procedure.

As Josef Mechtler, spokesman for the Korneuburg public prosecutor’s office, told the APA, there are still no concrete investigations against a suspect. It still has to be clarified whether there is sufficient suspicion to initiate personal investigations. The WKStA is now examining “whether it will get involved in the process,” said Mechtler. If this happens, one of the first steps would be for the WKStA to assess the suspicious situation.

The Korneuburg prosecution pointed out that the WKStA could initiate proceedings for abuse of official authority “in which there is a special public interest because of the importance of the criminal offense to be investigated or the person of the suspect.” Therefore, the file was “transmitted to the special authority specially appointed to conduct such proceedings for the examination of a course of action”.

The WKStA confirmed that it is currently examining whether the prerequisites are met to take ownership of the file. It is unclear when a decision on this can be expected.

The Cobra affair is basically about two bodyguards from Chancellor Nehammer’s family. The Cobra officials are said to have caused an accident with body damage after being drunk with the wife of the head of government.

The investigation on suspicion of abuse of office had been initiated by the prosecution in Wiener Neustadt. Due to the explosive nature of the case, the investigation was forwarded to the Vienna Public Prosecutor’s Office. This in turn had delegated the case to the authority in Korneuburg.
