The teenager and the girl had met through TikTok, said prosecutor Johanna Schunn in her indictment. The two entered into a relationship and soon the then 16-year-old pushed the more than three years younger to sex. As a result, the prosecutor saw the serious sexual abuse of minors realized. However, she also took the view that the young person was guilty of rape because the girl had been repeatedly assaulted against her will. However, the defendant denied this.
But what he admitted was an act last winter: when the relationship ended, he was accused of breaking into the 13-year-old’s room. He put a knife on the girl and demanded that she tell him the names of other guys with whom she allegedly cheated on him. Otherwise he would kill her and her family, the 17-year-old threatened before ramming the knife into the mattress of her bed.
The panel of judges, chaired by Judge Michael Schofnegger, excluded the public while the accused and the girl were being questioned. After a short deliberation, the verdict was reached: the 17-year-old was found guilty of serious sexual abuse of minors, severe coercion, dangerous threats, property damage and attempted physical harm, but was acquitted of the charge of rape. “A rape is characterized by the use of violence or dangerous threats. But if you give in to strong requests and urging, that is not the use of violence,” Schofnegger justified the acquittal.
The 17-year-old accepted the verdict. Prosecutor Schunn made no statement.
