El Salvador extended the state of emergency for 30 days to fight gangs

“We must create the necessary legal frameworks to prolong the emergency regime that this country needs for another 30 days. For the first time in the history of this country, serious actions have been taken that have not had a precedent. They are actions that will not last until here, that they are going to continue,” said the president of the Legislative Assembly, Ernesto Castro.

In the first 30 days of the state of emergency, more than 16,000 gang members were arrested and collaborators throughout El Salvador, according to figures from the National Civil Police.

The exception regime involves the suspension of some constitutional guarantees and can be applied “in cases of war, invasion of territory, rebellion, sedition, catastrophe, epidemic or other general calamity or serious disturbance of public order.” The opposition criticized that this measure cannot be resorted to due to a problem of common crime.

Article 30 of the Constitution establishes that the period of suspension of constitutional guarantees “shall not exceed 30 days.” Once this period has elapsed, the suspension may be extended for the same period and by means of a new decree “if the circumstances that motivated it continue.”

According to official figures, the Mara Salvatrucha Y neighborhood 18, among others, have some 70,000 active members in Salvadoran territory and as of Saturday morning, after 29 days of anti-gang operations, the National Civil Police reported 16,053 detainees during the emergency regime. As many as 590 of these arrests occurred on Saturday.

Human Rights Watch (HRW) and the Inter-American Commission on Human Rights (IACHR) They expressed concern about the imposition of a state of emergency in El Salvador, to which Bukele replied that these organizations “defend gang members.” Meanwhile, the United Nations also expressed concern about the wave of homicides in the Central American country.
