At the beginning of the trial, the accused had vehemently denied any intention to kill. The local told jurors he had never considered killing his father, even though he “loathed” him. He only recently found out that the father had raped a person from the immediate family environment, the accused said. His father finally admitted that to him. This put a lot of strain on him and “kept boiling up again and again,” the man stated.
Slumped in front of the house
Several witnesses called to the trial reported on the son’s aggression at the alleged time of the crime in the early hours of August 28, 2021. Three neighbors all stated that he had loudly and repeatedly threatened to kill his father. In addition, everyone had heard how the 30-year-old had repeatedly accused the father of said rape. After the apparently violent argument, the father left the house after around ten to 15 minutes and collapsed on a bench in front of the house.
According to forensic pathologist Walter Rabl, the man died of an acute heart attack. Violent effects on the head and neck area of the 52-year-old are still clearly detectable. Rabl did not assume that the injuries or the excitement contributed to the cause of the heart attack. Such a thing could have happened at any time. The father had numerous risk factors. His coronary vessels were “extremely constricted,” according to the expert.
“Neither intention nor attempt”
In their closing arguments, the prosecutor and defense attorneys stuck to their initial lines of argument. The prosecutor concentrated on aspects that point to an attempted murder – for example, led to the meeting of witnesses, according to which the man had threatened to kill his father. Nevertheless, he emphasized that the accused does not remember what happened and that the deceased had a serious heart condition. It is now a matter of deciding the intention of the accused.
The 30-year-old’s defense attorney argued that there was neither an intention to kill nor an attempt to kill the father. If he really wanted to kill his father, he could have used a knife that the defendant had in his pocket or hit him with a piece of furniture, the defense attorney said. The fact that his client had raged in the apartment was “clear”, he admitted, but emphasized that the deceased had “no serious injuries”.
Heavily drunk and aggressive
The 30-year-old son had apparently forced his way into his father’s apartment and also injured a police officer who arrived. According to the report, the accused was heavily intoxicated during the incident, but was still sane. He claimed that he could not remember what happened and that he did not know that his father had a serious heart condition. If convicted, the accused faces life imprisonment.
