32 Ryanair clauses declared invalid

The Vienna Commercial Court and the Vienna Higher Regional Court have declared 32 clauses in the general conditions of carriage of the low-cost airline Ryanair to be inadmissible. The objected clauses were unclear formulations, inadmissible restrictions on the assertion of claims and prohibited fees, wrote the Chamber of Labor (AK) Vienna, which had sued against 35 clauses, in a broadcast on Tuesday.

Ryanair had charged passengers a fee of 55 euros per person per flight for checking in at the airport. The court found the amount of the fee and the lack of a clear reference to the additional costs to be unusual and disadvantageous and therefore declared the clause inadmissible. The court also ruled that a fee of EUR 20 for reissuing the boarding pass if passengers did not have it with them and other fees were unlawful. Furthermore, numerous clauses were formulated unclearly and provided with cross-references, which made readability difficult. The assertion of claims is also disproportionately expensive for passengers.
